Terms of Use for FlashTronome

By downloading, installing, or using FlashTronome ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

1. Premium Monthly Subscription

Premium Features Include:

• Ad-Free Experience: Remove all banner advertisements
• Unlimited Recording Sharing: Share your audio recordings without restrictions
• Metronome Presets: Save and load custom metronome configurations

Auto-Renewal Terms:

• Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The cost of renewal will be the same as the initial subscription price unless you are notified otherwise
• You can manage your subscription and turn off auto-renewal in your Apple App Store or Google Play Store account settings

Cancellation Policy:

• You may cancel your subscription at any time through your App Store or Google Play Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds will be provided for the unused portion of any subscription period
• Upon cancellation, you will retain premium features until the end of your current billing period

Free Trial (if applicable):

• If a free trial is offered, you will be charged the subscription price after the trial period ends unless you cancel before the trial expires
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

2. Acceptable Use

FlashTronome is intended for personal music practice, learning, and performance. You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App in any way that could damage, disable, or impair the App or interfere with other users
• Not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices

3. Device Permissions

The App requires certain device permissions to function:

• Microphone: Required for tuner and audio recording features
• Camera/Flashlight: Required for flashlight synchronization with metronome
• Storage: Required to save audio recordings and app preferences

You can revoke these permissions at any time in your device settings, though this may limit app functionality.

4. Intellectual Property

All content, features, and functionality of FlashTronome, including but not limited to text, graphics, logos, audio samples, and software, are owned by the App developer and protected by international copyright, trademark, and other intellectual property laws.

5. Disclaimer of Warranties

FlashTronome is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any content

6. Limitation of Liability

To the maximum extent permitted by law, the App developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or recordings
• Device damage from flashlight use
• Hearing damage from audio playback at high volumes
• Any other damages arising from use of the App

Important Safety Notice: Use flashlight features responsibly. Prolonged exposure to bright lights can cause eye strain. Do not point the flashlight directly at eyes. Use audio features at safe volume levels to protect your hearing.

7. Refund Policy

All purchases are processed through the Apple App Store or Google Play Store. Refund requests must be submitted directly to Apple or Google according to their respective refund policies. The App developer does not process refunds directly.

8. Privacy

Your use of FlashTronome is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. Please review our Privacy Policy to understand our data practices.

9. Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of any material changes by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

13. Apple App Store Additional Terms

For users who download the App from the Apple App Store, you acknowledge and agree that:

• These Terms of Use are between you and the App developer, not Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms of Use and may enforce them

14. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and the App developer regarding the use of FlashTronome.
